The rental income on a well-finished two-bedroom basement suite in most Toronto neighbourhoods ranges from $1,800 to $2,600 per month in 2026, and in desirable areas closer to subway lines or the downtown core, it can exceed $3,000. Against a renovation investment that typically runs $80,000 to $160,000 fully built out, the arithmetic is hard to argue with.

But the critical word in that sentence is legal. Toronto has thousands of basement apartments that were built without permits, without inspections, and without meeting the fire and life safety requirements of the Ontario Building Code. Those suites carry real risk: for the tenant who lives there, for the homeowner who rents it, and for anyone buying a property where the basement income has been quietly factored into the purchase price without the buyer knowing the suite is non-compliant.

The rules governing basement suites have changed significantly over the past decade. The Province of Ontario mandated that municipalities permit second suites as-of-right in most residential zones, and Toronto's zoning bylaws were updated to reflect this. The 2012 and 2022 changes to the Ontario Building Code introduced specific technical requirements for secondary suites. Navigating all of this correctly requires understanding several layers of regulation that interact with each other.

What does "legal" actually mean?

A legal basement suite in Toronto is one that meets three distinct sets of requirements simultaneously: it is permitted under the applicable zoning bylaw for the property, it meets the technical requirements of the Ontario Building Code (OBC), and it was constructed under a building permit that was closed with a final inspection sign-off from a City of Toronto building inspector. All three must be true.

A suite can comply with the building code in every technical detail and still be illegal if the owner never pulled a permit. Conversely, a permit can be obtained and left open indefinitely because the work was never inspected. Neither of those scenarios gives you a legal suite. The only thing that does is a closed permit with all inspections passed.

The practical consequence of an illegal suite matters beyond theoretical compliance. If a fire or injury occurs in an unpermitted suite, your insurance company has grounds to deny the claim. If you sell the property with an undisclosed illegal suite, you face potential misrepresentation liability. And if the City of Toronto receives a complaint about an illegal unit, the enforcement process can result in an order to cease occupancy — forcing you to evict your tenant and either bring the suite to code or remove it entirely.

Key point: Toronto has been actively enforcing second suite compliance since 2020, and the volume of enforcement orders has increased year over year. Do not assume that because a suite has been renting for years without incident it will continue to do so. Enforcement is complaint-driven, and all it takes is one tenant dispute, a noise complaint, or a neighbour noticing the work being done.

Zoning: is your property eligible?

As-of-right permission for second suites exists across most of Toronto's residential zones under the City's Official Plan and Zoning Bylaw 569-2013. In plain terms, this means that if you own a detached, semi-detached, or rowhouse in a residential zone, you are almost certainly permitted to add one secondary suite as of right — without a rezoning application or Committee of Adjustment hearing.

Toronto also permits garden suites (detached structures in the rear yard) and, under the Province's More Homes Built Faster Act and subsequent amendments, allows up to three residential units on most low-rise residential lots. For the purposes of this guide, we are focused specifically on basement suites within the existing house structure.

Situations that may require additional review

While most residential properties in Toronto can accommodate a basement suite as-of-right, several situations warrant an early conversation with the City before design work begins:

  • Heritage properties or Heritage Conservation Districts: If your property is individually listed, designated, or located within a Heritage Conservation District (common in parts of Rosedale, Cabbagetown, The Annex, and Summerhill), there may be constraints on exterior alterations related to the suite, particularly a new separate entrance.
  • Flood-prone or ravine-adjacent lots: Properties within the Toronto and Region Conservation Authority (TRCA) regulated area or in the Flood Plain may require TRCA approval in addition to a City building permit.
  • Properties with existing non-conforming uses: If your property already has a suite and you are adding another, or if there are prior variances or conditions attached to the property, confirm your eligibility before starting design.
  • Stacked townhouses and certain condominium structures: These have different ownership and zoning frameworks and are typically not eligible for basement suites in the conventional sense.

The fastest way to confirm your zoning eligibility is to call the City of Toronto's Zoning and Committee of Adjustment section, or use the City's online zoning lookup tool. Any contractor who tells you to skip this step and just apply for the permit is giving you bad advice.

Ontario Building Code requirements for basement suites

The Ontario Building Code Part 9 (Housing and Small Buildings) and Part 3 (where applicable for fire ratings) set out specific technical requirements for secondary suites. These requirements were last significantly updated in 2022, and the 2026 requirements reflect those changes.

Minimum ceiling height

The OBC requires a minimum finished ceiling height of 1,950 mm (6 feet, 5 inches) throughout habitable spaces in a secondary suite. This is the single most common reason Toronto basement suites cannot be legalized without structural intervention. Older Toronto homes built before the 1970s routinely have basement floor-to-joist heights of 1,800 to 1,850 mm. Meeting the minimum typically requires either underpinning (excavating and lowering the basement floor) or bench-footing, both of which add significant cost.

It is worth knowing that the 1,950 mm requirement applies to the finished ceiling. If you have exposed joists at 2,050 mm and your planned ceiling assembly consumes 100 mm, you are right at the minimum. Understand the finished dimensions before you commit to a design that relies on tight clearances.

Bedroom window and egress requirements

Every bedroom in the secondary suite must have at least one window that meets the OBC's minimum openable area requirements for emergency egress. The minimum unobstructed openable area is 0.35 square metres, with neither the height nor the width of the openable area less than 380 mm. The sill height from the finished floor cannot exceed 1,000 mm.

In practice, this means that many existing basement windows are too small and too high to qualify. Window well excavation and replacement is standard scope on most basement suite projects for exactly this reason. It also means the bedroom layouts need to be designed with window locations in mind from the start — you cannot just put a bedroom wherever it fits and assume the existing windows will serve.

Separate entrance

The OBC requires that a secondary suite have its own exit to the exterior that does not require travel through the principal dwelling unit. In most Toronto houses, this means cutting a new door opening in the foundation wall (typically accessed from the side of the house), or creating an entrance from the rear of the property. A shared entrance through a common vestibule is acceptable in some configurations, but the tenant must be able to exit the building without entering the main unit.

Exterior entrance construction involves foundation work, grading, a stairwell, waterproofing, and often a landing and railings that must meet the OBC's stair geometry requirements. Budget $15,000 to $30,000 for this work depending on complexity and the amount of landscaping affected.

Fire and life safety requirements

This is the section of the code that is most often misunderstood or ignored in DIY and unlicensed basement suite builds, and it is the section where non-compliance creates the most serious risk to life.

Fire separation between units

The OBC requires a minimum 30-minute fire separation between the secondary suite and the principal dwelling, including between the suite and any common areas. In practical terms, this means:

  • The ceiling assembly between the basement suite and the main floor must be a rated assembly. Typically this means 12.7 mm (half-inch) Type X drywall on the underside of the floor joists, fully taped and finished, with all penetrations (plumbing, electrical, HVAC) properly fire-stopped.
  • The party wall between the suite and any shared utility space (furnace room, laundry) must be fire-rated, typically with a fire-rated door assembly where access is required.
  • Any door between the suite and the principal unit or common areas must be a solid-core door with self-closing hinges and an appropriate latch. The days of a hollow-core door between the basement stairwell and the suite are over for any legal build.

If the existing basement ceiling has original 9.5 mm drywall or, commonly in Toronto houses built before the mid-1970s, no drywall at all, full re-drywalling of the ceiling is required. This is not optional and cannot be waived by inspectors. We have seen projects where an owner tried to avoid this cost and ended up having the permit refused at the framing inspection stage, requiring demolition of completed work.

Smoke and carbon monoxide alarms

The Ontario Fire Code requires interconnected smoke alarms on every floor of the secondary suite, including the basement level, and interconnected with the smoke alarms in the principal unit. The interconnection means that when one alarm activates, all alarms in the building sound. Carbon monoxide detectors are required on every floor that contains a bedroom and in any room that contains a fuel-burning appliance.

The interconnection requirement is straightforward in new builds but can be complex in existing houses where the smoke alarms are battery-operated and not wired. A hardwired interconnected system is the cleanest solution and is what we install on every suite project. Wireless interconnected systems are permitted but introduce battery maintenance dependencies you do not want in a rental situation.

Sprinkler systems

Residential sprinkler systems are required for new secondary suites in certain scenarios under the OBC, specifically where fire separations of the required rating cannot be achieved through other means, or where the building does not otherwise meet the fire protection requirements. In most straightforward Toronto basement suite projects where the 30-minute fire separation is properly constructed, sprinklers are not mandated. However, they are required if the floor area of the suite exceeds certain thresholds or if the building has more than two dwelling units total. Your designer or contractor should confirm the sprinkler requirement for your specific project at the design stage, not after framing is complete.

Mechanical, electrical, and plumbing

A secondary suite must function as a complete, self-contained dwelling unit with its own cooking and sanitary facilities. This creates scope in three trades that is often underestimated in early budgets.

On the electrical side, the suite requires its own electrical panel or sub-panel with adequate capacity for the load. All wiring within the suite must meet the current Ontario Electrical Safety Code, which for bedrooms means arc-fault circuit interrupter (AFCI) protection. Permit applications for the electrical work go to the Electrical Safety Authority (ESA), not the City, and ESA inspections are separate from City building inspections. Do not conflate the two — a closed City building permit does not mean the ESA permit has been closed.

On the mechanical side, the suite needs its own heating source capable of maintaining 21°C in all habitable rooms. In most Toronto houses, the simplest approach is extending the existing forced-air system with a dedicated zone or running a ductless mini-split system for the suite. Shared HVAC systems are permitted but require careful analysis to ensure the suite can be heated independently if the principal unit controls are inaccessible. If the existing boiler or furnace is undersized, capacity upgrades may be required.

On the plumbing side, the suite kitchen and bathroom require tie-ins to the building's drain-waste-vent (DWV) system, which in older Toronto houses frequently runs at a height that requires a sewage ejector (sump pump) for basement fixtures. A sewage ejector system runs $3,000 to $6,000 installed and adds an ongoing maintenance consideration. All plumbing work must be inspected by the City's plumbing inspector under the building permit.

The Toronto permit process, step by step

Pulling a permit for a secondary suite in Toronto involves several sequential steps and typically multiple City departments. Here is how the process works in practice:

  1. Pre-application consultation (optional but recommended): For complex sites or any uncertainty about compliance, the City offers a pre-application consultation service where you can get written confirmation of what is required before spending money on drawings.
  2. Design and drawings: You will need architectural drawings prepared by a qualified designer (BCIN-registered) or architect showing the suite layout, door and window schedules, the proposed fire separation assembly, structural details for any underpinning or window enlargement, and compliance notes referencing the relevant OBC sections.
  3. Building permit application: Applications are submitted online through the City's Toronto Building Online portal. Expect a review period of 10 to 20 business days for straightforward applications; complex applications or those requiring zoning confirmation may take longer.
  4. Inspections during construction: Required inspections typically include: footings (if underpinning), framing, insulation, plumbing rough-in, mechanical rough-in, and final. The sequence matters — you cannot close walls before the framing and rough-in inspections have been passed and signed off.
  5. ESA inspection: Separate from the City process, required for all electrical work. The ESA issues its own certificate of inspection.
  6. Final inspection and permit close: Once all trades are complete and finished, the building inspector does a final review to confirm substantial compliance. This is when the permit is formally closed.

Timeline reality: From permit application to permit close on a typical Toronto basement suite project, allow six to nine months if you are starting the process from scratch. Experienced contractors who submit complete, well-documented applications consistently see faster review times than owners or contractors submitting under-documented packages that generate City comments and resubmission cycles.

What does a legal basement suite cost in Toronto?

Costs vary considerably based on the existing condition of the basement, the amount of structural work required, the suite layout, and the finish level. The table below reflects 2026 pricing ranges from our own projects and represents honest estimates — not best-case scenarios.

The most impactful variable in that table is underpinning. About half the basements we assess in Toronto's older housing stock — particularly in pre-war homes in the east end, Leslieville, Roncesvalles, the Junction, and similar neighbourhoods — have existing floor-to-structure heights that require lowering to meet code. Getting a clear-eyed assessment of whether underpinning is required, and what it will cost, before you commit to the project is essential.

Common mistakes that derail basement suite projects

After doing this work for 25 years and inheriting more than a few projects mid-stream after a previous contractor walked off the job or the owner ran out of budget, certain patterns repeat themselves:

  • Designing the suite before confirming ceiling height. The number of projects where a client came to us with floor plans already drawn by a designer who never visited the basement is remarkable. The ceiling height must be physically measured before design begins, not estimated.
  • Getting quotes before the drawings are complete. A quote without drawings is a rough number based on assumptions. When the drawings are complete and the scope is defined, the number changes — sometimes dramatically. Do the drawings first.
  • Underestimating the electrical scope. Owners routinely underestimate what a full ESA-compliant rewire and sub-panel installation costs. Electrical is not where to cut corners and not where to trust a quote from a contractor who has not reviewed the existing panel and service capacity.
  • Assuming the existing plumbing can handle the new fixtures. Older Toronto homes have cast-iron or clay drain systems that may be partially obstructed or sloped incorrectly. A camera inspection of the existing drainage before finalizing the bathroom location is $400 to $600 and can save you $15,000 in plumbing surprises.
  • Starting construction before the permit is issued. The permit review process sometimes surfaces requirements that change the design. Starting before the permit is issued means you may be building something that fails inspection. The carrying cost of a stopped project while design revisions are made and re-submitted is almost always worse than the delay from waiting for permit approval.
  • Treating the fire separation as optional. We have seen completed suites where an owner or handyman installed standard drywall on the ceiling instead of Type X and did not fire-stop the penetrations, reasoning that nobody would notice. Inspectors notice. And failing the framing inspection at that stage means tearing out finished work.

A contractor who has done this work at volume will have relationships with the relevant City departments, will know which inspectors are thorough and which move quickly, and will have standard details for the fire separation assemblies and fire-stopping that have repeatedly passed inspection.
